CM APPL. 30342/2024[Application seeking directions) 2.

This is an Application filed by the Petitioners seeking directions to the Respondent no. 1 to comply with the paragraph 5 of the Order dated 22.04.2024 passed in W.P.(C) 5520/2024 and to issue 'stop work' qua the property being Unit D, Part of Bungalow No. 1, 45 Mall Road, Delhi110054. 3.

and 3 submits that the Order dated 22.04.2024 was passed with respect to a show cause notice dated 14.03.2024 issued by the Respondent no. 1/MCD to the Respondent nos. 2 and 3. Although a representation has been made by the said respondents, a hearing qua the notice, has not taken place yet. 4.

The learned Counsel appearing for the Respondent No. 1/MCD on advance notice, at the outset, submits that he was present on the last date of hearing, although his presence has not been recorded. He further submits that the proceedings qua the show cause notice dated 14.05.2022 shall stand concluded within two weeks.

The Respondent no. 1/MCD is bound down to the statement made by its Counsel.

It is clarified that this Court has not examined the merits of the dispute while passing this order. All rights and contentions of the parties are left open in this regard.

The Application is disposed of accordingly.
