The present petition has been filed by the Petitioner-Govind Prasad Gupta, who claims to be a vendor in the Sarojini Nagar Market, under Article 226 of the Constitution of India, inter alia, seeking grant of a Certificate of Vending (hereinafter, 'CoV') as also an opportunity of being heard. 5.

The Petitioner had earlier submitted some documents to the New Delhi Municipal Council (hereinafter, 'NDMC') for the CoV which were found to be forged and certain proceedings in respect of the same are pending before The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The Petitioner had also filed another writ petition being W.P.(C) 7915/2024 titled 'Govind Prasad Gupta v. Govt. of NCT of Delhi & Ors.' in which interim protection was granted to the Petitioner in the following terms: "6. In view of the above, the present petition is disposed of by directing that the petitioner not be interdicted from carrying on his vending activities in opposite Shop No.165, Sarojini Nagar Market, New Delhi (open to sky, admeasuring 6ft. x 4ft.), subject to the petitioner carrying on vending activities in accordance with law.

7. We clarify that this arrangement would continue only till the survey is conducted and a vending plan is prepared." 7.

As can be seen from the above order, the arrangement which was directed by the Co-ordinate Bench of this Court was to continue only till the survey was conducted by the NDMC and the vending plan was prepared. 8.

After passing of the order dated 28th May, 2024 in W.P.(C) 7915/2024, the Petitioner has participated in the survey and the Town Vending Committee (hereinafter, 'TVC') has now taken a final decision in respect of the Petitioner which is extracted below:

"In view of the multiple complaints received from the Sarojini Nagar Market Shopkeepers Association alleging submission of manipulated and false documents, false affidavits, concealment of material facts, and abuse of the judicial process, the case does not merit favourable consideration.

Further, NDMC has categorically disclosed before the Hon'ble Court that the reported vendor has not been squatting since 2015. This position is corroborated by various NDMC survey reports, wherein the individual was not found vending in front of Shop No.165. In light of the above facts and records, the claim lacks credibility and is not recommended."

In view of the final decision of the TVC, the present petition would not be maintainable.

Accordingly, the present petition is disposed of. Pending applications, if any, are also disposed of.
