By way of present petition filed under Article 226 of the Constitution of India read with Section 482 Cr.P.C., the petitioner seeks direction to the respondent to release him on furlough, interms of order dated 13.11.2023 passed by DG Prisons, Delhi.

Learned counsel for the petitioner submits that vide the aforesaid order, the petitioner was directed to be released on furlough for a period of three weeks. The petitioner, however, did not avail the said benefit as he wanted to be released during the period of Ramzan. He further submits that despite the existence of the aforesaid order, the petitioner has not been released.

Learned ASC for the State submits that subsequently a punishment came to be recorded against the petitioner on 29.02.2024, for which reason he was not released on furlough.

Considering that the petitioner was eligible to be released on furlough and further that he was directed to be released on furlough for a period of three weeks vide order dated 13.11.2023, the present petition is disposed of with the direction that the petitioner be released on furlough immediately, on the same terms and conditions as mentioned in the order dated 13.11.2023. 6.
Copy of this order be communicated to the Jail Superintendent for information and necessary compliance.
