IN THE HIGH COURT OF DELHI AT NEW DELHI

+ W.P.(CRL) 1270/2019 ARUN SUREKHA ..... Petitioner Through Mr Debayan Ghosh, Advocates.

versus STATE & ANR.

..... Respondents Through Mr R.S. Kundu, ASC for State with Mr Shivom Saharan, Mr Hittesh Vali, Advocates.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 20.01.2020 1.

The petitioner has filed the present petition, inter alia, praying that the FIR No. 534/2016 under Section 420/406/120-B of the IPC registered with PS Alipur and all proceedings emanating therefrom, be quashed. 2.

The present petition has been premised on the ground that the disputes between the petitioner and the complainant, which were the subject matter of the FIR in question, stand resolved. The petitioner also averred that a similar Writ Petition [W.P. (Crl.) 750/2018] moved by another accused had been allowed. The petitioner further states that the disputes raised in the said FIR are, essentially, civil disputes and there is no culpability. 3.

A plain reading of the said FIR does not indicate that the allegations made in the same are civil in nature. It is also seen that the other petition [W.P. (Crl.) 750/2018] was not allowed as averred by the petitioner, but was dismissed on 06.05.2019 for non-prosecution.

4.

In view of the above, this Court finds no reason to quash the FIR in question. The petition is, accordingly dismissed. 5.

It is clarified that all rights and contention of the petitioner are reserved.
