The present petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail in the case FIR No.448/20202, for the offences punishable under Sections 307/34 IPC and Sections 27/54/59 of Arms Act, registered at PS Moti Nagar, Delhi.

Learned APP for the State accepts notice.

As per the call details record, location of the petitioner was at the place of incidence and he had calls with co-accused Rahul at 11:43 PM and 11:51 PM and the incident took place at around 11:45 PM. 5.

In view of above, I am not inclined to grant anticipatory bail to the petitioner.

Accordingly, the present petition is dismissed. BAIL APPLN. 1981/2020
