% 28.07.2017 IA No.8529/2017 is moved by the parties under Order 23 Rule 3 of the CPC pursuant to the settlement of disputes between them. Learned counsel for parties state that matter has been settled as per the terms and conditions embodied in para No.4 of instant application. The agreed amount of `75,000/-, per such settlement has already been received by plaintiff from the defendant towards damages and litigation costs.

Learned counsels for parties submit that both the parties have undertaken to adhere to the terms and conditions of the settlement as mentioned in para No.4 of application and shall be bound by it.

Accordingly, the suit of the plaintiff is disposed of having been compromised in terms of settlement as per the terms and conditions contained in para No.4 of the application which shall form part of the decree.

Pending applications, if any, are disposed of. Decree Sheet be drawn accordingly.
