Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') (read with Section 482 of the Code of Criminal Procedure, 1973) (hereinafter referred to as 'Cr.PC'), has been filed on behalf of the Petitioner, Khushi Ram, for quashing of FIR No. 0335/2020 under Section 354/354(A)/354B of the Indian Penal Code, 1860 (hereinafter referred to as 'IPC') registered at Police Station Narela Industrial Area, Delhi and all the consequential proceedings emanating therefrom, in view of the Settlement Deed dated 03.02.2025. On advance Notice, learned APP has appeared and accepts the Notice on behalf of the State.

The allegations are that the Respondent No. 2 is the daughter-in-law of the Petitioner. She had a lover marriage to the son of the Petitioner, which was not to the liking of the Petitioner. It is stated that the Petitioner is peace loving abiding citizen. The Respondent No. 2 is working with a pharma company. On 08.07.2020 when she was alone at home and her husband was not at home, in the middle of the night at about 1:00 a.m., she was sleeping in her bedroom, someone knocked the door and on opening the door, she found that her father-in-law was standing at the door in the seminude condition and stated to the Respondent No. 2 that she have to live with her like she is living with her husband, which means he wanted to have sexual favour from her. She further stated that she scared of him. 7.

On the Complaint of the Respondent No.2/Complainant, FIR No.0335/2020 under Section 354/354(A)/354B IPC, got registered at Police Station Narela Industrial Area, Delhi. Charge Sheet under Section 354/354(A)/354B of IPC has been filed on 21.04.2021 against the Petitioner. 8.

The FIR was a consequence of the matrimonial disputes between the Complainant and the Petitioner and apparently, on account of the Complainant not being accepted by the Petitioner. It is stated that the Petitioner and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement vide Memorandum of Settlement (MOU) dated 03.02.2025. In the Settlement, it was inter alia settled between the parties that they will not blame each other in future and live in harmony.

Today, the Respondent No. 2, who is present in the Court, states that she has no objection if the said FIR is quashed. 10.

Both the parties have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement.

Considering the nature of the allegations and the Complainant is living happily with her husband and that they have settled the matter, the FIR No. No.0335/2020 under Section 354/354(A)/354B IPC, got registered at Police Station Narela Industrial Area, Delhi and all the consequential proceedings emanating therefrom are quashed.

The Petition is disposed of accordingly.
