Petition under Section 482 of the Code of Criminal Procedure, 1973 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as „B.N.S.S.', has been filed on behalf of the Petitioner, for quashing of FIR No.0034/2021 dated 13.01.2021 under Section 288/337/304-A of the Indian Penal Code, 1860 (hereinafter referred to as „IPC') registered at Police Station Khyala, Delhi and all the consequential proceedings emanating therefrom, in terms of the mediated Settlement dated 30.12.2024.

On advance Notice, learned APP has appeared and accepted the Notice on behalf of the State.

Brief facts of the case are that the Respondent No. 2 is the Complainant/injured, as well as, real son of the deceased Smt. Urmila Devi. The Respondent No. 2 along with his family members including mother, Smt. Urmila Devi, used to live in the property of the Petitioner as a tenant and in the intervening night of 12/13.01.2021, some portion of roof fell down on the Respondent No. 2 and his mother in which the Respondent No. 2 suffered some injury and his mother expired, who was aged about 62 years at that time.

On the Complaint of the Respondent No.2/Complainant, FIR No.0034/2021 dated 13.01.2021 under Section 288/337/304-A of IPC, got registered at Police Station Khyala, Delhi.

It is stated that the Petitioner and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement dated 30.12.2024.

Today, the Respondent No. 2, who is present in the Court, states that he has no objection if the said FIR is quashed. 10.

The parties are present before this Court in-person today, and have been identified by their Counsel and Investigating Officer concerned and they have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement. 11.

Considering the nature of the allegations and that they have settled the matter, the FIR No.0034/2021 dated 13.01.2021 under Section 288/337/304A of IPC, registered at Police Station Khyala, Delhi and all the consequential proceedings emanating therefrom are quashed.
