The present writ petition has been filed seeking the following reliefs:- The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Mr. Puneet Mittal, senior counsel appearing on behalf of the petitioners, presses for relief only in respect of prayer (b), i.e. to permit the petitioners to carry out essential repairs, renovation and maintenance works in Flat No.H-403, Naraina Vihar, New Delhi ('subject property'). 3.

On instructions from the petitioners, who are present in Court, an undertaking is given to the Court that other than repairs, no other construction work shall be carried out.

3.1 The undertaking of the petitioners is taken on record and the petitioners shall be bound by it.

Counsel appearing on behalf of respondent-MCD on advance notice submits that a Show Cause Notice has been issued to the petitioners alleging unauthorized construction in the shape of excess coverage on the third floor and unauthorized construction on the entire fourth floor. 5.

A reply to the Show Cause Notice has been filed. It is submitted that the personal hearing has been fixed for 22nd May, 2026. 6.

Accordingly, the present writ petition is disposed of while permitting the petitioners to carry out repair/maintenance work only in respect of third floor of the subject property.

Needless to state, respondent-MCD shall adjudicate the Show Cause Notice issued on 21st April, 2026 and take action in accordance with law. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
