Accordingly, the application stands disposed of. CRL.M.C. 3701/2026 4.

The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereafter referred to as the 'BNSS') seeking quashing of FIR No. 294/2023 registered at Police Station Najafgarh for offences punishable under Sections 498A, 406 and 34 of the Indian Penal Code, 1860 (hereinafter referred to as the 'IPC'). 5.

Issue notice. The learned APP accepts notice on behalf of the State. 6.

The concerned Investigating Officer is present in Court, who has duly identified both the parties.

Brief facts of the case are that the marriage between the petitioner and the respondent no. 2 was solemnized on 26.11.2020 in accordance with Hindu rites and ceremonies. It is stated that the parties started living separately from July, 2024. Upon the complaint lodged by respondent no. 2, FIR No. 294/2023 came to be registered at PS Najafgarh against the petitioner and his family members. It is stated that during the pendency of the proceedings, with the intervention of family members the parties have amicably resolved all their disputes vide Mediation Settlement dated 21.09.2025. 8.

It is further stated that pursuant to the said settlement, the parties have resumed cohabitation and have been residing together peacefully since 08.10.2025. It is also stated that the respondent no.2 has no objection if the FIR in question is quashed qua the petitioner and the other family members named therein. It is stated that the charge-sheet has already been filed before the learned JMFC, Dwarka Courts, New Delhi, however, in view of the amicable settlement arrived at between the parties and in order to secure matrimonial harmony, the petitioners seek quashing of the present FIR and all consequential proceedings arising therefrom.

In view of the above, that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR No. 294/2023 and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 10.

Accordingly, FIR No. 294/2023 registered at Police Station Najafgarh under Sections 498A, 406 and 34 IPC, and all consequential proceedings arising therefrom, are hereby quashed.
