Applicant seeks interim bail on health grounds in case arising out of FIR No.0601/2025 dated 06.10.2025, registered at P.S. Palam Village for commission of offences under Sections 21 and 22 of Narcotic Drugs and Psychotropic Substances Act, 1985.

According to Ms. Dolly Sharma, learned counsel for the applicant, the applicant is suffering from multiple serious medical issues including piles and has to undergo multiple surgeries immediately. 3.
She submits that the government hospitals are overcrowded and there is a long waiting and, therefore, he is not getting any timely and proper treatment.

As per the report available on record, the treatment in question is available at DDU Hospital, but it seems that the applicant is not satisfied with treatment which he is receiving from the abovesaid hospital. 5.
The applicant is a Nigerian national who was found in possession of commercial quantity of contraband and, at the time of his arrest, since he had no friends or relative in Delhi, the intimation about his arrest was stated to be given to the Embassy.

It cannot be permitted to be heard from the applicant that treatment at the government hospital is of no use because of the reason that these are overcrowded.

During course of the arguments, it was proposed to the learned counsel for the applicant that, for her satisfaction, the applicant can be taken to the premium-most medical institute of the country i.e. AIIMS so that, as per the medical advice given by the Doctors at AIIMS, further treatment can be given and if required at AIIMS itself.

Ms. Sharma, learned counsel for the applicant submits that, in case the abovesaid direction is given, she would be left with no grievance, at the moment. She, however, seeks liberty to file fresh application before the learned Trial Court seeking interim bail in case the abovesaid direction also does not bring the desired result.

The present petition is disposed of with the direction to Jail Superintendant to make requisite arrangements to take the applicant to AIIMS for requisite medical check-up and further treatment. 10.
Let the abovesaid exercise be carried out within one week. 11.
The present application stands disposed of in aforesaid terms. Liberty, as prayed, is granted.
