The present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 20231 has been filed seeking directions to the Trial Court to expedite the proceedings emanating from RC No. RC220-2023-E0016 under Section 8 read with Sections 22 and 23 of Narcotic Drugs and Psychotropic Substances Act, 1985 registered at P.S. CBI, EO-II, Delhi on 6th July, 2023.

The Petitioner was arrested in the said proceedings on 13th July, 2023, and has been in custody since then. It is submitted that the Trial Court has not framed the charges against the Petitioner because the Investigating 1 "BNSS"

Agency has not filed the FSL report before the Trial Court. The Petitioner contends that the trial is proceeding at an extremely slow pace, and the trial is unlikely to conclude in the near future.

The Court has duly considered the aforenoted contentions. This Court does not find any ground to exercise the jurisdiction under Section 528 of BNSS. This Court cannot monitor the board of the Trial Court. The scheduling of dates is determined by the concerned Judge, taking into account several factors such as the judge's docket, the urgency, vintage and complexity of the matter. If the Petitioners have valid reasons for an expedited hearing, the proper course of action would be to file an appropriate application before the Trial Court seeking the said relief. 4.

In view of the above, the present petition is dismissed, along with pending applications.
