In deference to the observation made by the Court on 15.09.2025, learned counsel who appears on behalf of defendant no.1 contends that the name of the plaintiff has been removed from the concerned Article. 2.

Under the aforesaid circumstances, the Court finds that the substantial grievance of the plaintiff stands mitigated.

Learned counsel, who appears on behalf of the plaintiff however submits that the entire Court fee be directed to be refunded. 4.

Under the facts of the instant case, the Court deems it appropriate to directed to 50% refund of Court fee to the plaintiff by the Registry. 5.

With the aforesaid observations, the instant suit stands disposed of along with all pending application(s).

It is made clear that the aforesaid arrangement made, is under the peculiar facts and circumstances of the instant case and is not a precedent. Nothing stated hereinabove shall however amount to any expression on merits.
