The present petition under Section 11(6) of the Arbitration and Conciliation Act, 1996 had been filed seeking appointment of an Arbitrator. During the pendency of the present petition, the parties were referred to the Delhi High Court Mediation and Conciliation Centre, where they have arrived at a settlement. The terms of the said settlement have been duly incorporated in the agreement dated 24.12.2019, which has been placed on record.

Learned counsel for the parties jointly submit that most of the obligations under the terms of the settlement have already been discharged by the parties and the remaining obligations would also be discharged strictly in accordance with the terms of the settlement. They, therefore, jointly pray that the petition be disposed of in terms of the settlement agreement dated 24.12.2019.

In view of the parties having arrived at a settlement, the present petition seeking appointment of an Arbitrator is rendered infructuous and is disposed of as such.

It is however, made clear that both the parties will remain bound by the terms of the settlement agreement dated 24.12.2019 which will form part of the record.
