The present petition is filed seeking a third spell of furlough. The nominal roll indicates that the petitioner was released on first spell of furlough in the current conviction year from 13.01.2025 to 03.02.2025 for a period of three weeks. The second spell of furlough for a period of two weeks was granted to the petitioner from 02.04.2025 to 16.04.2025. 2.
The petitioner prays that the benefit of third spell of furlough which he would have been entitled to after spending a period of thirty days in custody, be granted to him for the reason that his house has been damaged due to earthquake and the same requires urgent attention.

The entitlement of the petitioner to the benefit of furlough has not been disputed but for the fact that he has not yet surrendered and spent 30 days in custody before he can be released on furlough. Therefore, purely on humanitarian grounds, the third spell of furlough which the petitioner would have been entitled to as per Delhi Prison Rules, 2018, for a period of two weeks, is granted starting from 23.04.2025 to 06.05.2025, on the same terms and conditions and bail bond and surety that were given by the petitioner at the time of his release on earlier occasion to the Jail Superintendent. In addition, the petitioner is directed to give one more surety for a sum of ₹10,000/- within a period of two days to the Jail Superintendent.

The petitioner is required to surrender on or before 06.05.2025.

The present petition is allowed in the aforesaid terms. 7.
It is made clear that the present order has been passed on the prayer made by the petitioner that if the benefit of third spell of furlough is granted now, he would not apply for another spell of furlough in the current conviction year as already having availed all three spells.
