This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:- "(i) Pass a writ, order or direction in the nature of declaration appointing Mrs. Rekha Kapoor as the guardian of Mr. Sanjay Kapoor with regards to all matters relating to his estate including but not limited immovable and movable properties, financial affairs, social security funds, etc., on such terms and conditions, if any, that this Hon'ble Court deems appropriate; (ii) Pass a further writ, order or direction in the nature of Mandamus directing the Respondent no. 3 & 4 and/or any The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
such other authority as this Hon'ble Court deems appropriate, to ensure that the Petitioner is facilitated in all respects to effectively discharge her duties as the legal guardian of Mr. Sanjay Kapoor and in relation to his estate; . . ." 2.
The case of the petitioner is that the husband of the petitioner met with a road accident and is admitted in Dharam Sheela Narayan Super-speciality Hospital and developed subdural hematoma (type of bleeding near one's brain).

The husband of the petitioner has undergone brain surgery and other medical procedures for survival.

On 18.04.2024, the husband of the petitioner was discharged from the hospital with the final diagnosis as severe head injury - acute right fronto-temporo-parietal subdural hematoma with multiple contusions and subarachnoid hemorrhage.

Thereafter, he was again admitted for the surgical management in the same hospital and is suffering from various complications. 6.
There is a certificate of Dr. Ashish Kr. Srivastava dated 31.03.2026, wherein it has been certified that the petitioner's husband is bedridden and unable to walk, read, write or sign the documents. 7.
For the said reasons, the petition has been filed seeking declaration of the wife Ms. Rekha Kapoor as the guardian of Mr. Sanjay Kapoor and permission for dealing with all matters related to estate including movable/ immovable, financial affairs, social security funds, etc. 8.
The notice was issued and the learned counsel for the GNCTD was required to ask the concerned SDM to visit the petitioner and submit a report.
