O R D E R

% 06.03.2017 Having regard to the value of the suit in which the decree under execution was passed, on account of change in the pecuniary jurisdiction, this execution petition is transferred to the file of the District Judge (South-West) at Dwarka Courts complex to which the territorial jurisdiction would pertain for further proceedings in accordance with law.

The judgment debtor through counsel submits that she has arranged the balance sum of Rs.16 Lakhs which she proposes to pay to the decree holder by way of a cheque which is ready for being handed over but the same may be passed on to the decree holder only upon the relinquishment deed being executed by that party. All such submissions and their consideration will have to be made before the transferee court for appropriate orders to be passed thereupon. EX.P. 8/2016

At the same time, it would be proper as suggested by the counsel for the decree holder that the balance money is deposited by the judgment debtor in the form of a demand draft rather than in the form of a cheque.

The parties shall appear before the transferee court on 06.04.2017.
