The petitioners no.1 and 2 are the Residents Welfare Associations (RWAs) and the petitioner no.3 is a Market Association in the locality of Govindpuri, Kalkaji, New Delhi-110019. The petitioners are aggrieved by the letter dated 23rd April 2026 issued by the respondent/MCD for discontinuation of the subject parking site. Multiple representations have been made by the petitioners to MCD (Annexure P-8 to P-14 of the writ petition), which are not being considered.

Mr. Rajiv Saxena, senior counsel appearing for the petitioners, submits that the subject parking, which is being used by the residents as well as shopkeepers, is being discontinued in order to hold religious/social functions such as Ramleela and Dussehra at the parking site. He has drawn the attention of the Court to the order passed by this Court on 22nd September, 2023, in W.P.(C) 12568/2023, wherein a specific statement had been made on behalf of MCD that the subject site will not be used for social/religious functions.
