The present application has been filed seeking interim bail in FIR No. 303/2014 registered under Sections 302/307/34 IPC and Sections 25/27/54/59 of the Arms Act at P.S. Subzi Mandi on the ground that the petitioner's wife is unwell and requires to undergo surgery for appendicitis on 03.09.2020.

Mr. Pradeep Chaudhary, learned counsel for the petitioner has referred to the medical documents from Anand Hospital, B-13, Nirmal Vihar, Najafgarh, New Delhi - 110043 in respect of the petitioner's wife and submits that the presence of the petitioner is required at the time of the surgery.

A Verification Report has been filed as per which, the medical documents in respect of the petitioner's wife are stated to be verified. BAIL APPLN. 1995/2020 Page 1 of 2

Ms. Radhika Kolluru, learned APP has raised an apprehension and submitted that the petitioner in the present case was apprehended only after he was declared a P.O. She further submits that as per the SCRB Report, the petitioner is found involved in 6 cases out of which in 4 cases, he is stated to be in judicial custody. She further submits that in another case being FIR No. 182/2010 registered at P.S. Bharat Nagar, the petitioner was declared P.O. She thus submits that the petitioner is a flight risk. 5.

Accordingly, it is directed that the petitioner shall be taken in police custody by the jail authorities to the aforesaid hospital tomorrow i.e. 03.09.2020 at 09:00 am and shall be brought back to the jail after 05:00 pm. 6.

Bail application is disposed of in the above terms. 7.

Copy of the order be sent to the concerned Jail Superintendent electronically.
