O R D E R

Learned counsel for the petitioner submits that subsequent to the filing of the present petition, necessary demolition action, as contemplated in the order dated 20.04.2026 passed in W.P.(C) 5206/2026, has been taken by the respondent/MCD. The order dated 20.04.2026 reads as under: "1. The present petition has been filed seeking direction to the respondent-MCD to stop the unauthorised construction being carried out at the property bearing no. M-28/A-1, Pocket-M, Dilshad Garden, Delhi- 110095 (hereinafter 'subject property').

2. Counsel appearing on behalf of the respondent-MCD, on advance notice, submits that the subject property has been inspected and encroachment has been found therein. Counsel submits that appropriate action shall be taken within ten (10) days from today.

3. Taking on record the aforesaid statement, the petition is disposed of. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 16/05/2026 at 11:36:41

4. SHO, P.S. Seema Puri who is respondent no.3, is directed to provide adequate police protection to the respondent-MCD to take the requisite action.

5. The pending applications also stand disposed of.

6. In the event, the petitioners have any further grievance with regard to the encroachment/ unauthorised construction, they are at liberty to take appropriate remedies in accordance with law.

7. All rights, contentions and legal remedies of the private respondent no.5 are kept open."

The said demolition action is stated to have taken place today itself, i.e. on 13.05.2026.

Let the MCD take action for removal of debris pursuant to the demolition action that has taken place.

In the circumstances, no further orders are required to be passed in the present petition; the same is accordingly, disposed of. 5.
