This application has been filed seeking withdrawal of the contempt petition.

Mr. Sandeep Sain, counsel for petitioner, appears through VC and contends that there was a commercial dispute with regard to the subject property between the petitioner and a third party that led to filing of the Writ Petition and then filing of the instant Contempt Petition. These facts have been stated in the application as well.

Considering that these aspects were never disclosed before the Writ Court or the Contempt Court, and the petition originally was filed alleging unauthorised construction at the subject property, the Court does not appreciate the petitioner moving the Court and using the legal process for setting a private dispute.

October 2024, but then again petitioner filed this contempt petition, which was heard by the Court, and notice was issued. 5.
In light of these facts, considering that the petitioner, in order to settle their private disputes, filed these petitions, the Court deems it appropriate to impose costs on petitioner.

Accordingly, withdrawal is allowed subject to costs of Rs.25,000/- to be deposited by the petitioner with the Delhi High Court Legal Services Committee within a period of 2 weeks.

Application stands disposed of in above terms. CONT.CAS(C) 579/2025 1.
Subject to payment of costs within 2 weeks and filing of receipt thereof with the Registry within a week thereafter, the petition stands dismissed as withdrawn.
