% 01.02.2016 The present bail application has been filed under Section 438 of the Code of Criminal Procedure read with Section 482 of Code of Criminal Procedure for grant of anticipatory bail. Perusal of the file shows that the petitioner/applicant approached the Court of Sessions for grant of anticipatory bail which was dismissed as withdrawn on the request of the petitioner/applicant.
In the facts and circumstances given above, the present bail application is dismissed with liberty to the petitioner to move a fresh application before the Court below for grant of anticipatory bail. It is made clear that the dismissal of the present bail application would not come in the way of the petitioner for moving application before the Court below.
