% 18.08.2020 The hearing has been conducted through video conferencing. 1.

The present petitioner has been filed under Section 439 read with Section 482 Cr.P.C on behalf of the petitioner for grant of interim bail in FIR 715/2016 for the offences punishable under Section 363/302/202/201 IPC, registered at Police Station Aman Vihar, Delhi. 2.

Learned APP has opposed the present petition by submitting that during the search conducted in the jail, some loose Tobacco (weighing approximately 01 gm) was recovered from inmate namely Heera Lal and petitioner herein, thus, his conduct in jail is not satisfactory. 3.

As per medical status report dated 14.08.2020, since 2016 petitioner is having pain in right knee and wrist. He is a patient of arthritis and was referred to Rheumatology department, AIIMS on 26.08.2017. Thereafter, on various dates he was taken to AIIMS to avail the required treatment. 4.

The petitioner is in judicial custody since 13.07.2016. It is pertinent to BAIL APPLN. 2033/2020

mention here that coordinate benches did not take into consideration the conduct of the petitioner in jail and thereafter this Court also followed the same and granted interim bail, keeping in view the minutes of meeting dated 18.05.2020 of High Powered Committee.

In this case also, I am of the view that conduct of petitioner mentioned above is not serious in nature and there is no other involvement of the petitioner, therefore, I hereby grant interim bail for a period of 45 days as per the guidelines dated 18.05.2020 of High Powered Committee. 6.

Accordingly, he shall be released on bail on his furnishing personal bond in the sum of ₹20,000/- with one surety of the like amount to the satisfaction of the Trial Court.

The petition is, accordingly, allowed and disposed of. 8.

Copy of this order be transmitted to the Jail Superintendent concerned and Trial Court for information and necessary compliance. 9.
