1. Mr. R. Santhanam, learned counsel appearing for the Petitioner informs the Court that insofar as the period for which the demand is sought to be enforced by the Department, and which is challenged in the present writ petition, an order has been passed by the Supreme Court on 15th September 2003 in Civil Appeal No. 6555-6573 of 2003 (Commissioner of Central Excise, Kanpur v. M/s. LML Limited) recording the fact that refund had already been given to the Assessee on 11th September 2003 and therefore, the said appeal was not being pressed by the Department.
2. Mr. Rahul Kaushik, learned counsel for the Department, seeks time to
verify the above details.
