O R D E R

% 19.02.2018 On 12th December, 2017, this Court had awarded compensation of Rs. 8,00,000/- along with interest at the rate of 7% per annum from the date of filing of the claim petition i.e. 14th December, 2011 till its realization. On 23rd January, 2018, it was recorded that the amount had not been deposited in the Court. On the following date i.e. 2nd February, 2018 this Court had directed that the amount be deposited within two weeks, otherwise a cost of Rs. 25,000/- would be payable to the appellant. The amount has not been deposited. Accordingly, Rs. 25,000/- is payable to the appellant. The learned counsel for the Railways submits that the compensation amount awarded shall be deposited in this Court in the next two weeks. Let it be so done on or before the 9th March, 2018 along with the aforesaid cost. For this extension of time, a cost of Rs. 12,000/- shall be paid. The learned counsel for the appellants states that appellant no. 1 is present in Court.

The Court is also informed that she does not have a Bank

Account. It will take her about a month's time to open one near her place of residence in Bihar.

Once the amounts are deposited by the respondent in this Court, the same shall be kept in an interest bearing FDR to enure to the benefit of the appellants.

Once the Bank Account details are furnished to this Court, an amount of Rs. 1,00,000/- from the compensation amount shall be released/ credited to the said Bank Account along with Rs. 15,000/- and Rs. 12,000/- of the costs. These amounts shall be for the benefit of the appellant No.1 and her children. The remaining amount shall be kept in an interest bearing FDRs of Rs. 15,000/- each, to mature every successive year. Upon maturity, the principal amount along with interest accrued shall be credited into her Bank Account. In case of any financial exigency, appellant No. 1 would have the liberty to approach this Court for appropriate orders.
