The present writ petition has been filed seeking setting aside of the communication dated 6th May, 2026, unilaterally terminating the petitioner's electricity connection bearing Consumer Account No.150462360 and the consequential grant of a fresh connection bearing Consumer Account No. 155149473 dated 7th May, 2026, in favour of respondent no.3, at property bearing C-2/15, First Floor, Krishna Nagar, Delhi-110051. 2.

Mr. Sharique Hussain, counsel appearing on behalf of respondent no.1/BSES Yamuna Power Limited, submits that the aforesaid electricity connection was in respect of first floor of the subject property. He submits that on the basis of an application filed by the respondent no.3, brother of the petitioner, electricity connection was changed from the name of the petitioner to the name of respondent no.3. the application was accompanied by a relinquishment deed dated 21st August, 2023 executed by the petitioner in favour of his brother, respondent no.3.

Counsel for the petitioner submits that he has challenged the aforesaid relinquishment deed. It is the case of the petitioner that the petitioner is now running his business from the basement of the subject property. 4.

In opinion of this Court, merely because a party is claiming ownership as per the written communication sent to the respondent no.1/BSES, it cannot be the basis to deny grant of electricity connection in favour of the petitioner. Grant of electricity connection is a basic right which cannot be denied to a party except in accordance with law. 5.

In view thereof, the present writ petition is disposed of while granting liberty to the petitioner to apply for a fresh electricity connection for the basement of the subject property. The same shall be considered by the respondent, without insisting on any ownership documents. The respondent shall process the application in accordance with its rules and regulations, subject to the petitioner complying with the prescribed formalities. 6.

Pending applications also stand disposed of.
