The petitioner has filed this petition under Section 11 of the Arbitration and Conciliation Act, 1996 ["the Act"] for adjudication of disputes between the parties arising out of a Master Service Agreement dated 28.03.2015. The agreement has an arbitration clause [clause 25.4]. 2.

Disputes having arisen between the parties, the petitioner invoked arbitration by a notice dated 19.12.2023, addressed to the respondent. However, the said notice failed to elicit a response. 3.

Pursuant to the order dated 23.04.2024, Mr. Dhirendra Negi, learned counsel for the respondent, states that the respondent does not object to the appointment of an arbitrator.

In view of the above, the petition is disposed of, by referring the disputes between the parties to arbitration of Hon'ble Mr. Justice Sanjib Banerjee, former Chief Justice of the High Courts of Madras and ARB.P. 510/2024 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The learned Arbitrator is requested to furnish a declaration under Section 12 of the Act, prior to entering upon the reference. 6.

It is made clear that all rights and contentions of the parties are left open for adjudication by the learned Arbitrator.
