O R D E R

The present application has been filed under Section 439 CrPC seeking interim bail in connection with FIR No.277/2018 under Sections 365/34 IPC (subsequently, charge sheet was filed under Sections 364A/302/201/120B/34 IPC) registered at PS Sarai Rohilla on the ground that the son of the petitioner is a chronic patient of kidney disease. 2.

Notice was issued in the present petition on 23.04.2024 with a direction to the State to file the Status Report. The Status Report has been handed over in the Court and the same is taken on record. 3.

A perusal of Status Report reveals that it is not in dispute that the petitioner's son is a chronic patient of the kidney disease but he has to undergo dialysis only once in a month.

Considering the aforesaid circumstances, this Court is of the view that the petitioner is entitled to interim bail. Accordingly, it is directed that the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. petitioner may be released on interim bail for a period of three weeks from the date of his release subject to his furnishing a Personal Bond in the sum of Rs.20,000/- and one Surety Bond of the like amount to the satisfaction of the Trial Court/CMM/Duty Magistrate, further subject to the following conditions:- a) Petitioner shall appear before the Court as and when the matter is taken up for hearing.

b) Petitioner shall provide mobile number to the IO concerned which shall be kept in working condition at all times and he shall not change the mobile number without prior intimation to the Investigating Officer concerned.

c) Petitioner shall not indulge in any criminal activity and shall not communicate with or come in contact with the witnesses. 5.

The petition stands disposed of.

Upon expiry of period of three weeks as stated above, the petitioner shall surrender before the Jail Superintendent. 7.

Copy of the order be forwarded to the concerned Jail Superintendent for necessary compliance and information.
