The present writ petition has been filed seeking a direction to the respondents no. 1 and 6 to take action against the unauthorized construction being carried out by the respondents no.2 to 5 at property bearing no. 76A/1, Main Market, Okhla Village, Jamia Nagar, New Delhi (hereinafter 'subject property').

It is stated that the petitioners are in occupation as owners of First Floor and half of Second Floor of the subject property. The grievance of the petitioner is with regard to the construction being carried out on the Fourth and Fifth Floor of the subject property.

Counsel appearing on behalf of the respondent no.1/ MCD on advance notice, submits that a show cause notice has been issued on 30th April, 2026 in respect of unauthorized construction in the shape of the Fourth Floor. Further, on the same date, a work stop notice has been issued to SHO, P.S.: Jamia Nagar calling upon them to immediately stop unauthorized construction. A communication has also been sent for electricity disconnection and water supply disconnection. 4.

In view of the above, the present writ petition is disposed of, while directing the respondent no.1/ MCD and SHO, P.S.: Jamia Nagar to take further action in accordance with law, in an expeditious manner. 5.

The respondents shall ensure that no further unauthorized construction is carried out in the subject property.

In the event, the petitioner has any further grievance with regard to unauthorised construction, the petitioner would be at liberty to take appropriate remedy in accordance with law.

All rights, contentions and legal remedies of the private respondents no.2 to 5 are kept open.

Pending applications stand disposed of.
