On 15.05.2024, the present case was reserved for judgment after hearing the parties.

Now, it has been brought to the notice of this Court by the learned counsels that as per the status being shown on the website of District Court, Central District, Tis Hazari Courts, the divorce petition pending before learned Judge, Family Court has been disposed of as ex-parte on 16.05.2024. 3.

The learned counsel for the petitioner submits that in these circumstances, the present petition has become infructuous, however, he seeks liberty to take all the averments as made in the present petition in an Appeal in case the divorce petition is decreed and he wishes to file an appeal.
