Applicant seeks regular bail in case arising out of FIR No.322/2022 dated 08.06.2022, for commission of offences under Sections 302/34 IPC, registered at Police Station Sarai Rohilla. Subsequently, in the charge-sheet, offences under Sections 324/174A IPC were added. 2.

The applicant was arrested on 29.02.2024 and is in custody since then. 3.

After the ascertainment of the charges, the case was put to trial and the prosecution has already examined all the material eye-witnesses, including the brother of the deceased.

Prosecution has cited 40 witnesses and out of those, 16 witnesses have already been examined.

Learned APP for the State, when asked, submitted that none of the eye-witnesses have supported the case of prosecution. 6.

As per the Nominal Roll, the age of the applicant is 23 years only and he has no previous involvement of any nature whatsoever. 7.

applicant and the fact that the material eye-witnesses have not supported the case of the prosecution, albeit, without expressing any opinion over the merits of the case, the applicant is directed to be released on bail on his furnishing personal bond and surety bond in a sum of Rs. 25,000/- each subject to the satisfaction of concerned Trial Court/Chief Judicial Magistrate/Duty Judicial Magistrate First Class with the following conditions: - (i) Applicant shall not try to contact any witness, directly or indirectly. (ii) Applicant shall furnish a mobile number to concerned IO on which he can be contacted, if required. Such number shall remain operational and functional.

(iii) Residential address of the applicant shall be got verified, before releasing him on bail.

Application stands disposed of in aforesaid terms. 9.

A copy of this Order be immediately sent to the learned Trial Court and Jail Superintendent for information and necessary compliance.
