The present bail application seeks regular bail in proceedings arising from FIR No. 72/2023 registered under Section 377 of the Indian Penal Code, 1860, Sections 4/6 of the Protection of Children from Sexual Offences Act, 2012 and Section 67 of the Information Technology Act, 2000 at P.S. Alipur.

Petitioner's earlier application was rejected by the Trial Court on 21st March, 2025 and the Petitioner has now approached this Court barely a month later.

After making arguments in part, counsel for Petitioner states that he would like to withdraw the present application and seeks liberty to file afresh before the Trial Court at the appropriate stage. 4.

Dismissed as withdrawn, along with pending application, with liberty as aforesaid.

It is made clear that in case the Petitioner files a fresh bail application before the Trial Court at the appropriate stage, Petitioner must disclose material change in circumstances since the rejection of the previous bail application. On disclosure of such material change in circumstances, the Trial Court shall then consider Petitioner's request on its own merits, in accordance with law.
