IN THE HIGH COURT OF DELHI AT NEW DELHI

+ W.P.(C) 4755/2019 PINKY ..... Petitioner Through:

Ms Nabila Hasan and Ms Ranidipa Ghosh, Advocates.

versus HINDU RAO HOSPITAL & ORS ..... Respondents Through:

Mr Sachin Nahar, Advocate for R-2 and R-3/Director Helath and GNCTD.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 07.05.2019 1.

The petitioner has filed the present petition, inter alia, praying that directions be issued to the respondents to provide the Child Death Review and all medical records relating to the delivery of a child by the petitioner. The petitioner also prays that an independent enquiry be conducted and necessary action be taken against the concerned medical health providers of respondent no.1 for negligence in performing their duties. 2.

The petitioner claims that she was admitted to respondent no.1 hospital on 15.05.2018 and delivered a baby weighing 3.13 kg on 16.05.2018. She states that the child was stated to be kept under medical care but subsequently was declared to be dead. The petitioner was discharged on 17.05.2018. The learned counsel appearing for the petitioner submits that notification of child's death, as is required to be furnished by

the duty medical officer, was not furnished within the period of 24 hours of the death of the child.

It is also stated that the petitioner has visited the hospital several times but has received no information from that. 3.

It is seen from the record that there is no material to establish that the petitioner had sought any information from respondent no.1 hospital. The allegations made by the petitioner are also not supported by any material on record.

In view of the above, the present petition is disposed of by permitting the petitioner to approach respondent no.1 by filing an appropriate application seeking the documents or the records, which the petitioner desires or considers necessary. The Superintendent of respondent no.1 hospital is directed to provide the petitioner copies of all necessary records as sought by her. It is further clarified that if the petitioner is able to establish any of her allegations on the basis of the records so furnished, the petitioner is at liberty to apply afresh.
