It is not disputed that the petitioner had resigned from the accused company with effect from 02.07.2014 whereas the cheques were issued on 11.11.2016.

The petitioner also was only a nominee Director of the accused company and was nominated on behalf of the State Bank of India.

In view of the above, the impugned order dated 28.11.2018 insofar as it issues summons to the petitioner, is set aside. 5.
