The accused/applicant seeks anticipatory bail in case FIR No. 33/2026 of Police Station Cyber Police Station West, Delhi for offence under Section 318(4)/319/340/61(2)/3(5) BNS.

Broadly speaking, the prosecution case is that the complainant Rajiv Bansal alleged that his credit card details were misused by someone to the tune of Rs.1,76,000/-. The IO calls this a cyber fraud. During investigation, the money from the said credit card was found to have been credited in the bank accounts of one Mohd. Sarfaraz and Mohd. Rehan, who have been arrested. When they were in police custody, Mohd. Sarfaraz and Mohd. them to open such bank accounts. It is on this basis of that the IO claims that the present accused/applicant is the kingpin of the cyber fraud syndicate. 3.
Learned counsel for accused/applicant contends that there is no legally admissible evidence or material to arrest the accused/applicant. 4.
Learned APP on instructions of IO/SI Praveen Kumar in all fairness does not oppose this anticipatory bail application provided the accused/applicant joins the investigation and cooperates. Learned counsel for accused/applicant submits that he is ready to join investigation. 5.
Under these circumstances, this anticipatory bail application and the accompanying application are allowed and it is directed that in the event of his arrest, the accused/applicant shall be released on bail, subject to his furnishing a personal bond in the sum of Rs.10,000/- with one surety in the like amount to the satisfaction of the IO/SHO concerned. It is specifically directed that the accused/applicant shall join investigation as and when directed in writing by the IO.
