M/s Pureca Laboratories Pvt. Ltd. suffered a decree and, accordingly, one Execution Petition was filed against them by the plaintiff/decree-holder Ms. Meenu Jain.

When the abovesaid Execution Petition was taken up by the learned Execution Court on 27.03.2025, the director of the JD Company made a prayer that he would pay the decretal amount within six months and was ready to pay first instalment of Rs. 1.5 lacs, the same day. 3.

However, since the abovesaid proposal was not found acceptable to the decree-holder, the learned Execution Court directed issuance of warrant of attachment of all the plants, raw material and machinery of the JD company lying in premises in question which is situated in Bawana, Delhi-110039. Such order dated 27.03.2025 is under challenge. 5.

Mr. Mandeep Baisala, learned counsel for petitioner, has, however, apprised that there is subsequent development in the matter as, when the abovesaid Execution Petition was taken up by the learned Trial Court on 16.04.2025, there was some settlement between the decree-holder and, the objector and in view of such settlement, the Execution Petition as such has been disposed of as withdrawn.

A copy of such order dated 16.04.2025 has been shown and has been retained on record.

In view of the above, Mr. Mandeep Baisala, learned counsel for petitioner submits that the present petition has become infructuous and, therefore, he does not seek any further relief. 8.

Since the Execution Petition, as such, does not survive anymore and has already been withdrawn by the decree-holder, the present petition is disposed of as having become infructuous.
