This is a petition seeking setting aside of the order dated 29.02.2024 and 25.01.2024 passed by the learned District and Sessions Judge and to direct the learned Sessions Court to hear the appeal without any precondition. 2.
On 25.01.2024, the learned Judge was pleased to direct the payment of 30% of the amount and thereafter the arguments on application under Section 5 of the Limitation Act were to be heard and the appeal would be entertained.

Mr. Jain, learned counsel for the petitioner states that as per the calculations, a sum of Rs. 3.4 lakhs is 30% of the arrears. A sum of Rs. 2.61 lakhs already stands paid and the balance sum of Rs. 79,000/- shall be paid on or before 16.12.2024.

79,000/- shall be paid in 2 instalments, one before 16.12.2024 and the other shall be paid on or before 15.01.2025.

Taking the statement of the petitioner on record and after the payment of such sum of Rs. 79,000/-, the appeal filed by the petitioner herein may be heard.

The appellant shall also continue to pay the regular maintenance as ordered by the Court till the same is varied or modified by the appellate Court.
