O R D E R

The present bail application has been filed seeking anticipatory bail in FIR No. 95/2018 under Sections 380/448 IPC registered at Police Station K.N. Katju Marg, Delhi.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. He submits that in pursuance to the last directions, the petitioner has joined the investigation. He further submits that during the investigation, the petitioner has handed over the chain of documents i.e. notorized GPA, Special Power of Attorney & agreement to sell between him and one Ajay Aggarwal, the previous owner. 3.

Learned APP for the State, on the other hand, has opposed the bail application. He submits that the previous owner namely, Ajay Aggarwal as well as witnesses to the aforesaid documents have denied the execution of the documents.

In rebuttal, learned counsel for the petitioner submits that a civil suit bearing No. 417/2019 filed by the complainant-Sudhir Dabas is also pending between the parties.

In view of the above facts and circumstances of the case and the fact that the petitioner has joined the investigation, it is directed that in the event of arrest, the petitioner be released on bail, subject to her furnishing a personal bond in the sum of Rs.25,000/-with one surety in the like amount to the satisfaction of the Arresting Officer/Investigating Officer/SHO of the concerned police station and also subject to the following conditions:- (i) The petitioner shall join investigation as and when she is asked to do so.

(ii) The petitioner shall not directly or indirectly make any inducement, threat or promises to the complainant or any witness during the trial or tamper with the evidence. (iii) The petitioner shall provide the I.O./SHO Police Station K.N. Katju Marg, Delhi with her mobile number and in the event of change of his residential address, shall inform the same to the I.O./SHO as well as to the concerned Court.

(iv) The petitioner shall not leave the jurisdiction of the National Capital Territory of Delhi without prior permission of the concerned Court.

The bail application is disposed of in the above terms. 7.
