None appears for the appellant when the matter is called out. 2.

When the matter was listed on the last date of hearing, i.e., 23rd January, 2025, this Court had recorded that the appellant company has already been struck off by the Registrar of Copyrights ("ROC"), in terms of the information as available on the Ministry of Corporate Affairs' website. 3.

The order dated 23rd January, 2025, reads as under: "1. Learned counsel appearing for respondent no. 1 submits that as per the official record available on the Ministry of Corporate Affairs ("MCA") website, the appellant company has already been struck of by the Registrar of Companies ("ROC"). Thus, he submits that the appellant company is no longer in existence.

2. Mr. Abhay Anand Jena, learned counsel appearing for the appellant, submits that he shall take instructions from the promoters of the company and requests for time in that regard.

3. If the appellant company has already discontinued the use of the mark and trade name 'KRRISH', and Mr. Abhay Anand Jena, Advocate, takes instructions in that regard, then the present appeal can be disposed of, accordingly.

Learned counsel for the appellant had been directed to take instructions. However, none appears for the appellant. 5.

Considering the fact that the appellant company has already been struck off by the ROC, it is apparent that the appellant company, is no longer existing and is a non-entity.

Accordingly, noting the aforesaid, the present appeal is dismissed, along with the pending applications.
