% 06.05.2019 Crl.M.A. 9629/2019 Allowed subject to all just exceptions.

CRL.M.C. 2436/2019 Quashing of FIR No. 79/2018, under Sections 376/377/365/354/ 450/323/34 of IPC, registered at police station Malviya Nagar, New Delhi is sought on merits.

Petitioner's counsel submits that despite ten opportunities, the prosecutrix, who is a foreign national, has not been produced before the trial court and so, proceedings arising out of FIR in question be brought to an end.

Upon hearing, it is deemed appropriate to dispose of this petition

with direction to the trial court to make all the endavours to secure presence of prosecutrix and in any case, complete the trial of this case within a year from today, as petitioner is also stated to be a foreign national.
