O R D E R
% 04.02.2020 Vide the present petition, the petitioner seeks bail in pursuance to FIR No.538/2018 registered at Police Station Tilak Nagar for the offence punishable under section 21/25/29 NDPS Act.
It is not in dispute that substance recovery is of 100 gms. of heroine which is intermediate quantity and the petitioner is in judicial custody since 20.10.2018 and till date, not even a single witness has been examined. It is also not in dispute that section 37 of the NDPS Act is not applicable in the present case.
Therefore, without commenting upon the merits of the case, I am of the opinion that the petitioner has made his case fit for bail. Accordingly, he shall be released on bail on his furnishing personal bond in the sum of ₹25,000/- with one surety of the like amount to the satisfaction of the Trial Court.
The petition is, accordingly, allowed and disposed of. Copy of this order be transmitted to the Jail Superintendent and the Trial Court concerned for compliance.
