The present petition under Section 401 of the Code of Criminal Procedure, 1973 seeks following prayers:- "In view of the facts and circumstances narrated hereinabove, it is most respectfully prayed before this Hon‟ble Court to: Allow the present revision petition and revise the impugned order on charge dated 27.07.2023 and 23.08.2023, titled as "State vs. Deepak Khanna" passed by Ld. Additional Sessions Judge-05, North West District, Rohini Courts, Delhi, in so far as the charge under Section 302 and 120B of the Indian Penal Code, 1860 is concerned; in SC No. 371/2023.

Pass any further order(s) and/or direction(s), which this Hon‟ble Court may deem fit and proper in the interest of justice." 2.

Learned counsel appearing on behalf of the petitioner, after some arguments, seeks leave to withdraw the present petition. 3.
