CM(M) 74/2016 & C.M. No.2632/2016 Order impugned before this Court is the order dated 16.11.2015 vide which the Appellant Court has set aside the order passed by the Civil Judge vide which the suit of the plaintiff (seeking possession and mesne profits) had been decreed under Order XII Rule 6 of the CPC. The impugned order had set aside this decree. At this stage learned counsel for the petitioner seeks permission of this Court to withdraw this petition with observation that any observations contained in the impugned order will not influence the finality of the judgment which is yet to be considered and passed by the Trial Court.

Permission granted dismissed as withdrawn with the aforesaid observations.
