This Letters Patent Appeal has been preferred by the original petitioners against the order dated 06.07.2020 passed by learned Single Judge in W.P.(C) 7135/2019. Initially status quo was granted by the learned Single Judge vide order dated 21.10.2019, which was subsequently modified LPA 195/2020 Page 1 of 2 N PATEL Location:

pursuant to an application preferred by respondent No.3 under Article 226(3) of the Constitution of India.

The original petitioner no. 7 thereafter made an application for permission to the writ petitioners to utilise the part of the land in question which is not being utilised by respondent no. 3 (Public Works Department) for construction of a flyover. By an order dated 06.07.2020, the learned Single Judge has issued notice in the said applicaton, and directed that it will be listed alongwith the writ petition on 10.08.2020. The said order dated 06.07.2020, which is under challenge in this LPA, is at Annexure-1 to the memo of this LPA.

Learned counsel appearing for the appellants, after canvassing some arguments on behalf of the appellants, submitted that it would suffice for the disposal of this LPA if the appellants are permitted to raise their arguments in the writ petition before the learned Single Judge on the date already fixed, i.e.10.08.2020.

In view of this limited submission, we see no reason to go into the legality of the order dated 06.07.2020 in W.P.(C) 7135/2019 (Annexure-I to the memo of this LPA).

With these observations, this LPA is disposed of. Pending application also stands disposed of.
