The present application has been filed on behalf of the plaintiff for withdrawal of the present suit under Order XXIII Rule 1 read with Section 151 of the Code of Civil Procedure, 1908 ("CPC"). 2.
Learned counsel for the plaintiff submits that the present suit has been filed by the plaintiff seeking declaration and permanent injunction, in respect of various moveable and immoveable properties, based on a Family Settlement dated 26th November, 2020 and two registered Wills dated 07th September, 2020 and 07th December, 2020, respectively. However, she submits that the present application for withdrawal of the suit has been filed by the plaintiff voluntarily, consciously and on his own free will, without any coercion, duress or undue influence.

Learned counsel for the plaintiff has drawn the attention of this Court to the proof of service to contend that the counsel for the defendants has been served through E-mail.

Considering the submissions made before this Court, the present application is allowed, and the plaintiff is permitted to withdraw the present suit.

The present suit is accordingly dismissed as withdrawn. 7.
Pending applications also stand disposed of.
