The petitioner has filed the present petition, inter alia, seeking anticipatory bail in connection with FIR No.0342/2017, under Section 420 of the IPC, registered with PS Bawana. It is alleged that the petitioner had entered into an Agreement to Sell a plot of land measuring 238 sq. yards situated at Mukhtiyar Singh Marg, Bawana, Near Post Office. He had also collected the consideration of ₹55 lakhs for the said sale from the complainant.

The complainant, who has since expired, had reported that the documents subsequently executed by the petitioner were only pertaining to land measuring 112 sq. yards. Furthermore, that plot is stated to have been allotted under the 20-Point Programme and, therefore, could not be sold by the original allottee.

The status report has been filed, which indicates that the petitioner is

required to be interrogated.

Considering the above facts, this Court does not consider it apposite to allow this petition. The same is, accordingly, dismissed. VIBHU BAKHRU, J OCTOBER 09, 2019 MK
