Learned counsel appearing for the respondent, under instructions, submits that the demand notice was inadvertently issued by the department without noticing the stay order granted in the appeal. He submits that by a subsequent order dated 10.09.2020 the demand notice dated 03.06.2020 issued on 03.06.2020 has been withdrawn and further action, if any, shall be taken subject to order of the Central Government Industrial Tribunal in Appeal No. D-1114/2019. The statement is taken on record. 3.

In view of the above, learned counsel under instructions for the petitioner seeks leave to withdraw the petition. The petition is, accordingly, dismissed as withdrawn.
