(T) (COMM.) 8/2017 & IA Nos.1174/2016 & 1176/2016 The learned counsel for the defendants states on instructions of Mr Subhash Aggarwal, who is present in the Court, that they are agreeable if a Sole Arbitrator is appointed by this Court to adjudicate the disputes. The learned counsel for the petitioner concurs with the above. In view of the above, the present petition be allowed and the mandate of the Arbitral Tribunal consisting of Mr. P. S. Singhal, Mr Puneet and Mr Sanjay Poddar stands terminated.

(Retired) (Mobile No.9560899997), former Judge of High Court of Delhi is appointed as the Sole Arbitrator to adjudicate the disputes between the parties.
The parties are at liberty to approach the Arbitrator for holing a preliminary hearing. This is subject to the Arbitrator making a necessary disclosure under Section 12 of the Act and ineligible under Section 12(5) of the Act.
