The present contempt petition has been filed by the Petitioners under Section 12 read with Section 2(B) of the Contempt of Courts Act, 1971 seeking contempt action against the Registrar of Cooperative Societies (hereinafter, 'RCS') alleging violation of an undertaking given, as recorded in the order dated 3rd November, 2025 passed by this Court in W.P.(C) 11977/2025.

The order dated 3rd November, 2025 in W.P.(C) 11977/2025 reads as under:
"1. Counsel appearing for respondent no.1 states that proceedings for according sanction to prosecute the Office Bearers of the Society as provided under Section 118 of Delhi Cooperative Societies Act, 2003 ('DCS Act') shall be concluded within 12 weeks from today.
2. This statement is accepted.
3. Let the decision be taken by said authority be communicated to the petitioner.
4. We further expect a response from respondent no.1 as to what further action can be initiated against the office bearers for not complying with directions issued under Section 139 DCS Act.
5. Let a response be placed on record within 2 weeks from today.

7. In the meantime, on petitioner taking steps through all permissible modes, notice be issued to unserved respondents, returnable before this Court on the next date of hearing.

The grievance of the Petitioners is that the RCS is not taking any action against the Jyoti CGHS Limited (hereinafter, 'the Society') and its management.

In the order dated 3rd November, 2025, passed in W.P.(C) 11977/2025, which is extracted hereinabove, as per paragraph 1, the proceedings for according sanction to prosecute the office bearers of the Society were to be concluded within twelve weeks from 3rd November, 2025. 7.
It is alleged by the Petitioners that no sanction has been accorded till date, and the order dated 3rd November, 2025 has not been complied with. 8.
On behalf of the RCS, the submission is that the orders have been passed on 12th May, 2026 , as per which the RCS has imposed a penalty of Rs.10,000/- on the Society, for not providing the requisite information. In this regard, various orders, which have been passed on 12th May, 2026 by the RCS, have been handed over to the Court.

Considering that the orders have been passed by the RCS, the violation, if any, is only in respect of the time period in passing the orders. The proceedings have reached a culmination. Accordingly, the delay in passing the said orders is condoned.

orders. Thus, the Petitioners are at liberty to avail of their remedies in accordance with law, including filing of an application in the main petition. 11.
No further orders are called for in the contempt petition which is disposed of in these terms. Pending applications, if any, are also disposed of. W.P.(C) 11977/2025 12.
The primary prayer of the Petitioners in the present petition is that the membership has not been transferred by the Society in the name of Petitioner No.1, as per order dated 28th February, 2024 passed by the RCS. 13.
The Court has considered the matter. Let the office bearers of the Society, Petitioners and the RCS participate in the Mediation proceedings before the Delhi High Court Mediation and Conciliation Centre, and if any documents are required from the Petitioners, the same may be submitted by the Petitioners to the RCS and the transfer of membership shall be looked into by the RCS. A responsible office bearer of the Society shall participate in the Mediation. Petitioner and RCS shall also be duly represented. 14.
List before the Delhi High Court Mediation and Conciliation Centre on 5th June, 2026 at 11:00 AM.
