By way of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioners assail the summoning order dated 17.01.2026, passed by the Magistrate's Court in Complaint Case No. 650/2025 under Section 12 of the Protection of Women from Domestic Violence Act, 2005 ["the DV Act"].

Mr. Mohit Kumar Gupta, learned counsel for the petitioners, states that, as the impugned order is susceptible to appeal under the DV Act, the petitioners seek permission to withdraw this petition, without prejudice to the appellate remedy available to them.

The petition, alongwith pending applications, is dismissed as withdrawn, in terms of the above.

It is clarified that this Court has not made any observation on the merits of the case.
